Lawyers for elected U.S. President Donald Trump cited a pardon issued by U.S. President Joe Biden for his son Hunter in their motion to dismiss the case regarding the falsification of financial documents by the Trump Organization in connection with payments made to former porn actress Stormy Daniels.
“Donald Trump is filing a motion to dismiss the indictment and overturn the jury’s verdict,” the document submitted to the New York court states. Lawyers Todd Blanche and Emil Bove explained this request by invoking presidential immunity, which applies to Trump. Additionally, they referred to Biden’s decision to pardon his son Hunter, quoting the presidential order in their document.
“By issuing a pardon for Hunter Biden, covering any crimes he may have committed over the past 10 years, President Biden claimed that his son ‘is being subjected to selective and unfair prosecution,'” the Trump lawyers reminded. “President Biden stated that ‘politics influenced the process, leading to a judicial error.'”
According to Blanche and Bove, these statements apply to Trump’s prosecution as well: “Since District Attorney [Alvin] Bragg took office, he has staged exactly the kind of political theater President Biden condemned.” The lawyers believe that this case “would never have been initiated if it weren’t for Trump’s political views… and the political threat he poses to corrupt politicians in Washington and beyond.”
At the end of May, Trump was found guilty on all 34 counts in the case involving the falsification of financial documents. He became the first former president in U.S. history to be found guilty of a crime by a jury. In November, Judge Juan Merchan agreed to delay sentencing in the case.
