At the session of October 15, the government recognized the overriding public interest regarding the 100% shares of "Armenia Electric Networks" CJSC belonging to the "Tashir" group of companies. The owner of the "Tashir" group of companies is Samvel Karapetyan, the detained leader of the "Strong Armenia" bloc. The justification states: "Revocation of the license by the Public Services Regulatory Commission of Armenia showed that the state assessed possible violations as capable of harming the interests of hundreds of thousands of subscribers. The principle of overriding public interest allows the state to intervene when the right of citizens to receive uninterrupted and safe services is threatened, on whose activities normal livelihoods, industry, state structures depend. roads, transport and communication systems. If the government body justifies that the existing problems in the field of electricity distribution threaten public interests, then the intervention can be considered legal. According to the Constitution, the right to property is not absolute and can be limited in order to ensure the overriding public interest, observing the principles of proportionality, legality and necessity. In this case, the overriding public interest is expressed by the necessity of uninterrupted provision of vital services to the population of the republic, maintenance of energy security and protection of public order. Therefore, taking into account the exceptional importance of the company's activities, its influence on all spheres of public life, as well as the natural monopolistic nature of the sphere, there are sufficient grounds for prioritizing its activities. to recognize an existing interest. Recognizing 100% of the shares of the closed joint-stock company "Electric Networks of Armenia" as a priority public interest is due to the need to ensure the safety of the state and society.
